BACKGROUND
David has been representing local governments in Western Australia since 1979. Before joining McLeods, he was the partner in charge of the Planning, Environment and Local Government practice group at the national law firm Corrs Chambers Westgarth.
Since joining McLeods in 2001, David has concentrated on local government enforcement and assisted numerous local governments in implementing a fresh approach to enforcement resulting in far more expeditious and economical resolutions to problems. Levels of fines and costs regularly recovered for local governments using new enforcement regimes, have often exceeded the local government’s total spending on legal services in a given financial year.
EXPERIENCE
Particular aspects of David’s experience include:
• Many thousands of prosecutions conducted over 26 years of prosecuting under planning, environmental, health, local government and other relevant legislation, local laws and schemes.
• Drafting of town planning schemes and local laws with a particular emphasis on enforcement aspects.
• Representing both local governments and developers in town planning appeals to the Town Planning Appeal Tribunal, the Minister for Planning and the State Administrative Tribunal.
• Appearing as counsel in all court jurisdictions ranging from Magistrates Courts to the Supreme Court and High Court of Australia in civil, criminal and appellate jurisdictions.
